As employers, business owners, or hiring managers, you may have heard of Adverse Action with regards to job applicants and FCRA compliance. Here are the three basic steps:
1. Job applicant signs release form to let you do a background check on him/her.
2. Background screening company begins the screening process and the background request is completed. The report is sent to potential employer.
3.Your company HR professional or hiring manager reviews the report:
Adverse info was found OR No Adverse
Info was found.
(Hire Candidate)
- Send Pre-Adverse Action Letter
- Copy of Consumer Report (from background search company)
- Copy of the FCRA Summary of Rights
- Adverse Action Letter (after waiting a reasonable amount of time)
